What is professional negligence?

Professional negligence is the failure of a professional, whether they be a company, individual or a group to carry out and provide the services to the expected standard resulting in a loss. You’ve likely encountered negligence if you paid for a service that directly caused you reputational damage or financial loss.

Whether it stems from a trusted financial firm or an independent property professional, negligence can happen in many sectors. Our professional negligence solicitors handle cases involving:

  • A breach of contractual obligations
  • A failure to follow your instructions
  • Providing incorrect legal advice
  • A failure to provide advice

Our team of experienced professional negligence lawyers supports individuals and companies let down by trusted providers. In our online guide, you’ll find all you need to know about professional negligence, including examples and steps involved in making a claim.

You should take property negligence seriously. Whether you’ve encountered problems buying, selling or maintaining a building, our professional negligence lawyers can help with:

Claims against surveyors

Chartered surveyors are responsible for identifying risks in construction or renovation projects, or providing advice and guidance when buying a property. They’re regulated by the Royal Institution of Chartered Surveyors, and as with all professionals you should expect a professional standard from them. Professional negligence solicitors FAQs:

Please get in touch to start your claim.

During your initial consultation, we’ll ask you what has happened. This will give us an idea of your circumstances so we can assess whether there was any professional negligence. If we think you’ve got a valid claim, we’ll ask you if you’d like to proceed. Unlike many firms, we handle many cases on a No Win No Fee basis.

Your case will be assigned to one of our professional negligence solicitors who will start investigating. This involves gathering information and sometimes consulting independent experts and writing a formal Letter of Claim to the professional.

We’ll handle every step of the process and keep you updated. For our solicitors, professional negligence cases involve assessing details and finding missing pieces. Most cases are resolved without formal litigation, but we’re prepared to take your case to court if necessary.

Yes. You should contact professional negligence lawyers within six years of the date the negligence occurred. This is known as the primary limitation period and is set out in the Limitation Act 1980, which details the time limits on various claim types.

However, there are two limitation periods for professional negligence claims:

Primary limitation period: You’ll usually need to bring a professional negligence claim within six years from the date of the breach or the date of the loss.

Secondary limitation period: This is often referred to as Date of Knowledge and applies where the issue is unknown and only becomes discoverable later. The limitation period is extended by a further 3 years from when the knowledge was acquired.

Unlike a lot of firms, we offer a No Win No Fee service, if we believe your claim has reasonable chances of success. This means we only get paid if we win and nothing if we lose. If your case is successful, we’ll charge a Success Fee, typically up to 30% of the compensation award.
